FCC Slaps ESPN with Huge Fine for Misusing Emergency Alerts in NBA Ads!

In the lead-up to the NBA’s regular season, ESPN’s promotional campaigns are generally ubiquitous, but a recent series of promos has unexpectedly drawn the ire of the U.S. government.

The network is facing a proposed fine of $147,000 from the Federal Communications Commission (FCC) for the unauthorized use of an emergency-alert sound effect in its NBA advertisements, as per a statement released on Thursday.

“The misuse of Emergency Alert System (EAS) tones when there’s no emergency is a serious matter,” stated FCC enforcement leader Loyaan Egal. “Such actions can create significant public safety hazards by generating confusion and potentially disrupting real emergency communications.”

This is not the first instance where a sports broadcaster has been penalized for improper use of emergency-alert sounds. ESPN itself has previously faced penalties for similar infractions, and David Shepardson from Reuters reported that Fox was fined a much larger amount for a similar issue involving an NFL promo in 2021.

“ESPN will have the opportunity to contest these charges and present evidence and legal arguments,” stated the FCC. “The commission will then review these materials before making a final decision on the matter,” added the release.
